Land and foreign buyers

A foreigner cannot hold land freehold in Thailand. The usual routes are a registered long lease or a Thai company with genuine Thai shareholders, and never nominee shareholders, which is a criminal offence. Which route fits a given case is a question for a licensed Thai lawyer before anything is signed. See freehold vs leasehold.

Frequently asked questions

Can a foreigner buy land in Thailand?

Not in their own name. The common legal routes are a registered lease (maximum 30 years), usufruct, superficies, or a genuine Thai company with real Thai shareholders who contribute real capital. Nominee shareholders used to hold land for a foreigner are illegal under the Foreign Business Act.

What is a rai?

A rai is the Thai land measure: 1 rai is 1,600 m². The Sukhumvit plot of 115 rai is therefore 184,000 m².

What is the price per square metre of the Sukhumvit plot?

THB 1,725,000,000 divided by 184,000 m² is about THB 9,375 per m². This is a calculation from the asking price, not an independent valuation.

What can be built on the plot?

The listing suggests a resort, hotel or villa project, a commercial park or mixed-use development. Those are suggestions from the seller. What is actually permitted depends on zoning and planning rules that must be confirmed with the local authority and a Thai lawyer.

What are off-market plots?

Plots whose owners have not put them on property portals. Four are held at the moment (Bang Saray, Mabprachan Lake, Pratumnak Hill and Khao Mai Kaew). Title deed, photographs, price and development notes are sent on request.
